DESCRIPTION OF GOODS
NampaFitStudio.com provides access to fitness instruction both live and via video and audio content. Before using this content, it is highly recommended that you consult your physician to determine whether physical exercise is recommended and safe for you.

YOUR MEMBERSHIP ACCOUNT
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use our website only with involvement of a parent or guardian. NampaFitStudio.com and its associates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

No Sharing

Members of The Studio may not share, give or sell their password or username to any other person or entity. When becoming a Member you agree to take all actions possible to protect your username and password from fraudulent use.

Fraudulent Use

The Studio reserves the right to cancel any membership it believes has been compromised, or is being used fraudulently, at our own discretion.

BILLING
Memberships are billed monthly. All memberships are renewed automatically until canceled. Members may cancel their membership at any time. Membership must be canceled 30 days prior to the renewal date in order to end membership charges. At times, special prepaid membership packages will be available for purchase. Special prepaid memberships will be recurring and will renew automatically on the expiry date. Membership must be canceled 30 days prior to the renewal date in order to end membership charges.

REFUNDS
Credits expire one year (365 days) from date of purchase and unused credits are non-refundable. Monthly Membership fees are non-refundable.
Unused purchased credits may be transferred to another student only in these extreme situations; relocation – with proof of new address. As recommended by physician – with written recommendations in consideration of credit expiration dates.
Free or promotional credits may be transferred in part or in full to another student with the approval of owner.

LIABILITY
By registering for a Studio program or class, you agree that Nampa Fit Studio is in no way responsible for the safekeeping of personal belongings while attending class. You understand that classes at The Studio may be physically strenuous and that you voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death. You agree that neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Nampa Fit Studio or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.

REVIEWS, COMMENTS, EMAILS, AND OTHER CONTENT

Visitors may post reviews, comments, and other content: and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “:spam.”: You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. By visiting NampaFitStudio.com, you agree that the laws of the state of Idaho, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and NampaFitStudio.com or its associates.

DISPUTES
Any dispute relating in any way to your visit to NampaFitStudio.com or The Studio facility or products you purchase through NampaFitStudio.com shall be submitted to confidential arbitration in Idaho, except that, to the extent you have in any manner violated or threatened to violate NampaFitStudio.com intellectual property rights, NampaFitStudio.com may seek injunctive or other appropriate relief in any state or federal court in the state of Idaho, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

SITE POLICIES, MODIFICATION, AND SEVERABILITY
Please review all other policies posted on this site. These policies also govern your visit to the Nampa Fit Studio facility. We reserve the right to make changes to our site, policies, and these Terms of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

MEDIA CONSENT
By participating at The Studio you grant all rights to use, reuse, publish and republish and otherwise reproduce, modify, and display the same, in whole or in part, individually or in conjunction with other matter and in conjunction with any other matter in any and all media developed, and to use your name in connection with The Studio. This use includes video, television, cablecasting, still images, World Wide Web (WWW) sites, and printed materials, and includes the image, voice, appearance, activities or participation. You release and discharge NampaFitStudio.com from any and all claims in connection with the use of the images and my name, likeness, and identity, including without limitation any and all claims for libel, privacy, or publicity.
